Our Experts

Robert Anderson

Robert supervises the Wills, Trusts, Tax and Probate team.  He is the Managing Director of RDC Solicitors and has over 30 years experience as a Solicitor .

Andrew Jameson

Andrew Jameson qualified as a Solicitor in 1992 and been Head of Probate for several large regional firms and a Partner in two firms, he is now a self-employed Locum Solicitor.  Andrew is a highly regarded professional who has acted for a number of high profile clients and has also acted as the Executor for several Senior Judges who choose him to deal with their Estates and to protect their family’s wealth.   He is experienced in all aspects of Wills, Probate and Trust work and was approved by the Court of Protection to work as an External Receiver for individuals who need assistance with their finances.    

In recent years he has acted for many Estates which included foreign property and in addition to the usual countries like France, Spain and India he has dealt with estates that included assets in Malaysia, Romania,  Belize and the Bahamas.

Belinda Fox

Belinda is a highly regarded Solicitor with has over 30 years’ experience dealing in all aspects of Wills, Trusts, Tax and Probate work.  She has acquired a first class reputation for providing clear and pragmatic advice, whilst maintaining an empathetic approach to all her clients.

After leaving school Belinda worked for the Tax Office for 7 years. During that time she studied for her A Levels & London University external Law degree.

Belinda qualified as a Solicitor in 1986 and joined the firm which was then known as Dunn Connell. She became a partner in 1988 and was also a former managing partner of the firm.  Belinda retired from the partnership a number of years ago and now concentrates her time providing specialist advice and assistance in all areas of this work.  She has a particular interest in dealing with complex estates and tax planning.

Ian Cormack

Ian is a Trusts and Estates Probate Executive who has over 20 years’ experience in dealing with Wills, Probate, Powers of Attorney, Court of Protection matters and Trusts.

Ian graduated from the University of Leicester in 1994 achieving a BA in American Studies. After graduating Ian worked as a Court Manager in the Probate Service as well as a Wills, Trusts, Tax and Probate fee earner in firms in Leeds and Bradford. Ian has been with RDC Solicitors for 4 years and is available to see clients at all three RDC offices in Bradford, Bingley and Ilkley.

Ian has completed several professional development courses in Wills and Probate and presents Wills and Probate pre-retirement seminars for the NHS in West Yorkshire.

Ian prides himself in dealing with clients in a compassionate and caring manner.

Pricing

The following price guides do not apply to contested estates or to estates where there are assets outside the UK.

Probate Application Only  

Price (excluding VAT & Disbursements)

£800 - £1,200

 What is included:

  • Initial meeting.
  • Preparing a statement of assets and liabilities of the estate from the information supplied by you.
  • Preparing the Inheritance Tax Account/ Return and sending it to you for approval.
  • Meeting with you to go over the paperwork.
  • Applying for and obtaining The Grant of Representation.

What is not included:

This service does not include obtaining details of the assets and liabilities of the estate, the distribution of the estate, Deeds of Variation, dealing with Department of Work and Pensions investigations, locating missing beneficiaries, transferring /selling property in the estate, establishing and administering trusts created by the Will or searching for unknown assets.

Disbursements

In addition to the legal fees there will also be disbursements (fees payable to third parties).  The most common of these are listed below:

  • ID Search

£1.20 per Client

  • Oath Fee

£5-£7 per Client

  • Probate Court Fee

£155 plus 50p per Office Copy

  • Notice to protect against claims from unknown creditors

£200-£400

The exact cost of the application for Probate will depend on the particular circumstances of the estate.  For example if there is one beneficiary and a small number of investments the costs will be at the lower end.  If there are multiple beneficiaries and/or investments and/or the deceased made lifetime gifts the costs will be at the higher end.  Please speak to a member of our Wills, Trusts, Tax and Probate team who will be able to give you a more accurate price for the estate concerned.

If unforeseen issues arise in relation to the estate there may be additional charges but we will discuss these with you before the costs are incurred.

On average it takes 4-6 weeks from the date on which we receive full details of the estate from the client to obtain the Grant of Probate.

Probate and Administration of the Estate

Price (excluding VAT & Disbursements)

Starting at £1,500

 

 What is included:

  • Initial meeting.
  • Searching for unknown assets (if required).
  • Advertising for unknown creditors (if required).
  • Registering the death, and obtaining details of the value of the assets and liabilities of the estate.
  • Preparing a statement of assets and liabilities of the estate.
  • Preparing the Inheritance Tax Account/Return and sending it to you for approval.
  • Preparing the application for Probate.
  • Meeting with you to go over the paperwork.
  • Arranging for any Inheritance Tax due to be paid.
  • Applying for a Grant of Representation.
  • Registering the Grant and arranging for the assets of the estate to be cashed and/or transferred.
  • Finalising the Income Tax position of the estate.
  • Finalising the Inheritance Tax position of the estate.
  • Paying any legacies and transferring any specific gifts contained in the Will.
  • Producing Estate Accounts and distributing the remainder of the estate.

What is not included:

This service does not include transferring/selling property in the estate and establishing and administering trusts created by the Will.

Disbursements

In addition to the legal fees there will also be disbursements (fees payable to third parties).  The most common of these are listed below:

£2.00 per beneficiary

The costs of administering estates vary.  It all depends on the particular circumstances of the estate concerned.  For example, if there is one beneficiary, no property and a small number of investments the cost will on or near the starting rate.  If there are multiple beneficiaries and/or investments and/or Inheritance Tax to pay the costs could be significantly higher.

The length of time it can take to administer an estate can also vary significantly.  For example: 

  • If the sale of a property is involved it may not be possible to finalise the administration of the estate until the sale is completed;
  • If the estate is liable to Inheritance Tax it will not be possible to finalise the administration until all the Tax has been paid and clearance obtained from H M Revenue and Customs.

Stages of the Process

Information about the process is set out in the pricing tables above.

Some indication is given regarding timescales for a Probate only application above, but timescales generally will depend on the complexity of estate and further information can be given after the initial meeting.
